 Federal Mandates for FBI Fingerprint Checks

As of March 2009, there is pending legislature in both the House (Child Protection Improvements Act of 2009) and Senate (The Patient Safety and Abuse Prevention Act) which would require volunteers and employees of youth-serving and long-term care industries to undergo a nationwide criminal background check using the FBI’s fingerprint database.
The fingerprint database has been available to school districts, daycare providers and other industries for a number of years, but was not federally mandated. Should these laws pass, it will mean a significant change in the way background checks are conducted. Potential employees will have to undergo fingerprint scans at certified collection locations. These fingerprints would then be run through the FBI’s database in a process that can take weeks to complete. For those employers with the need for quick turnaround, this may pose a problem.
